سکوت در قبال کشتار ۱۶۸ کودک در مدرسه میناب اعتبار نظام بین‌المللی حقوق بشر را با چالشی جدی مواجه می‌کند

به گزارش خبرگزاری آگاه، ستاد حقوق بشر با انتشار بیانیه‌ای اعلام کرد: ادامه سکوت و انفعال در قبال کشتار بی رحمانه ۱۶۸ کودک بی گناه و بی‌دفاع در میناب، اعتبار نظام بین‌المللی حقوق بشر را با چالشی جدی مواجه خواهد ساخت. ستاد پیگیری حقوقی این جنایت را با استفاده از تمامی ظرفیت‌های حقوقی بین المللی و حقوق بشری با قاطعیت دنبال خواهد کرد.

متن کامل این بیانیه به شرح زیر است:

تجاوز وحشیانه رژیم صهیونیستی و امریکا به مدرسه در شهر میناب جنایتی هولناک و سازمان‌یافته به شمار می‌آید که در نتیجه آن ۱۶۸ دانش آموز بی‌گناه بین سن ۷ تا ۱۲ سال به شهادت رسیده و ده‌ها نفر دیگر مجروح شده‌اند.

بی تردید هدف قرار دادن عامدانه کودکان در محیط آموزشی، نقض فاحش و آشکار اصول و قواعد بنیادین حقوق بین‌الملل، حقوق بشردوستانه مندرج در کنوانسیون‌های چهارگانه ژنو ۱۹۴۹ و پروتکل‌های الحاقی آن به‌ویژه اصل تفکیک و اصل تناسب و موازین حقوق بشر از جمله کنوانسیون حقوق کودک و همینطور اصول انسانی و اخلاقی محسوب می‌شود.

ابعاد این جنایت وحشیانه آنچنان دلخراش و وسیع بوده که سبب وحشت سایر کودکان و جریحه دار شدن احساسات عمومی مردم ایران و افکار عمومی جهانی شده است که بی تفاوتی و نادیده انگاشتن آن توسط مراجع و مقامات حقوق بشری لکه ننگی بر پیشانی آنها خواهد بود که هیچگاه پاک نخواهد شد.

این جنایت هولناک بسیاری از مفاد و موازین الزام اور حقوق بشری را نقض می‌کند که از آن جمله می‌توان به نقض صریح تعهدات الزام‌آور ناشی از کنوانسیون حقوق کودک اشاره کرد؛ مانند حق ذاتی کودک بر حیات (ماده ۶)، حق حمایت در برابر هرگونه خشونت (ماده ۱۹)، تعهد دولت‌ها به حمایت از کودکان در زمان مخاصمات مسلحانه (ماده ۳۸) و حق بنیادین آموزش (مواد ۲۸ و ۲۹). افزون بر آن، مفاد میثاق بین‌المللی حقوق مدنی و سیاسی در خصوص حق حیات و نیز میثاق بین‌المللی حقوق اقتصادی، اجتماعی و فرهنگی در خصوص حق آموزش، به‌صورت آشکار به واسطه این جنایت فجیع نقض شده است.

این جنایت وحشیانه گواه آشکاری است که این دو رژیم خونریز کودک کش که تلاش می‌کنند تجاوز به ایران را در زیر سایه دروغ پردازی‌های مزورانه مبنی بر تلاش برای آزادی مردم ایران مخفی نمایند نسبت به هیچ جنایتی حتی قتل و عام کودکان، دختران و زنان و افراد غیرنظامی فروگذار نیستند.

گرچه برخی از سازوکار‌های بین المللی مانند صندوق کودکان سازمان ملل متحد (یونیسف) به‌ذعنوان نهاد تخصصی نظام ملل متحد در حوزه حمایت، بقا و رشد کودکان، این جنایت را محکوم و آن را نقض قوانین بین‌المللی دانسته است، اما پر واضح است که این موضع‌گیری‌ها و صرف محکوم سازی‌ها کافی نیست و ضرورت دارد که همه مقامات نهاد‌ها و سازوکار‌های حقوق بشری به ویژه کمیسر عالی حقوق بشر و شورای حقوق بشر ضمن محکوم نمودن و ابراز انزجار از وقوع این جنایات و سایر جنایات جنگی رخ داده در جریان تجاوز به ایران، همه ظرفیت‌ها و ابزار‌های لازم را برای پاسخ‌گو نمودن و پیگیری مسؤولیت آمران و عاملان این جنایت وحشیانه به کار گیرند. این رخداد هولناک و ضد انسانی آزمونی برای ارزیابی کارایی این نهاد‌ها محسوب می‌شود.

از این‌رو، انتظار می‌رود سایر سازوکار‌های بین‌المللی، از جمله دفتر کمیساریای حقوق بشر و شورای حقوق بشر سازمان ملل متحد، و دیگر سازوکار‌های حقوق بشری، با کنار گذاشتن انفعال و بی عملی این جنایت وحشتناک را که نمونه‌ای روشن از جنایت جنگی است، به‌صراحت محکوم کرده و سازوکار‌های لازم برای بررسی ویژه و جلوگیری از تکرار آن شناسایی و پاسخگو کردن عاملان، آمران و حامیان آن را فعال کنند.

ادامه سکوت و انفعال در قبال کشتار بی رحمانه ۱۶۸ کودک بی گناه و بی‌دفاع، اعتبار نظام بین‌المللی حقوق بشر را با چالشی جدی مواجه خواهد ساخت. حقوق کودک، حقی جهان‌شمول و غیرقابل تفکیک است و نمی‌توان آن را تابع ملاحظات سیاسی و استاندارد‌های دوگانه قرار داد.

ستاد حقوق بشر جمهوری اسلامی ایران ضمن ابراز همدردی عمیق با خانواده‌های داغدار و مردم شریف میناب و کشور، اعلام می‌دارد پیگیری حقوقی این جنایت را از تمامی ظرفیت‌های حقوقی بین المللی و حقوق بشری با قاطعیت دنبال خواهد کرد و از جامعه جهانی می‌خواهد در برابر این فاجعه انسانی، مسؤولانه، شفاف و بدون تبعیض اقدام کند.

The Statement of the High Council for Human Rights of the Islamic Republic of Iran on its Second Objection to the Violent Attacks of the Zionist Regime and the United States and the Increase in the Number of Martyred Students of the School in Minab.

Killing ۱۶۸ children in Minab is the gross violation of international law and a historic experiment for the international community.

The violent aggression of the Zionist Regime and the United States against the school in Minab is a dreadful and organized crime in which ۱۶۸ innocent students, between ۷ to ۱۲ years old, were martyred and dozens of other students were injured.

Undoubtedly, intentional targeting of children in an educational setting is a gross violation of fundamental rules and principles of international law and humanitarian law stipulated in the Four Geneva Conventions ۱۹۴۹ and their additional protocols, specifically the principles of separation and proportionality as well as the human rights standards including the Convention on the Rights of the Child, and the humane and moral principles.

Different aspects of this violent crime has been so tragic and extended that brought about fear in other students and irritation of public feelings in Iran and international community. The indifference and ignorance of these feelings by human rights authorities and bodies will be a blemish for them that will never be forgotten.

This dreadful crime violates many of human rights obligatory principles and standards, including the violation of mandatory obligations in the Convention on the Rights of the Child, like the inherent right to life (article ۶) , the right to be protected from any violence (article ۱۹) , the obligation of states on protecting children in the time of armed conflicts (article ۳۸) , and the fundamental right to education (articles ۲۸ & ۲۹). Moreover, the provisions of the International Covenant on Civil and Political Rights regarding the right to life and the provisions of the International Covenant on Economic, Social and Cultural Rights regarding the right to education have been violated through this calamitous crime.

This violent crime is a clear evidence of the fact that these two child killer regimes who try to cover their act of aggression under the shadow of an effort for the freedom of Iranian nation, commit all crimes even killing children, women and girls and civilians in the country.

Although some international mechanisms such as UNICEF, as the specialized body of the United Nations in the field of protection, survival and development of children, have condemned this crime and considered it as a violation of international law, it is obvious that these positions and mere condemnations are not enough. It is necessary that all human rights officials, bodies and mechanisms particularly the High Commissioner for Human Rights and the Human Rights Council, while condemning and announcing aversion against these crimes and other war crimes committed during the aggression against Iran, use all necessary capacities and tools to make the perpetrators of these violent crimes accountable. This dreadful and inhumane event is an experiment for the assessment of the efficiency of these bodies.

Therefore, it is expected that international mechanisms like the Office of the High Commissioner for Human Rights and the UN Human Rights Council and other human rights mechanisms, while stopping being passive and inactive, explicitly condemn this dreadful crime which is a clear example of war crime, recognize and activate the necessary mechanisms for specific investigation and prevention of reoccurrence of these crimes, and for the accountability of the perpetrators, commanders and the supporters.

Continuing to be silent and passive in the face of brutal killing of ۱۶۸ innocent and defenseless children, challenges the credibility of international human rights system. The rights of the child is a global and inseparable right and can’t be followed by political considerations and double standards.

The High Council for Human Rights of the Islamic Republic of Iran, while expressing deep sympathy with mourning families and the decent people of Minab and the whole country, announces that it will firmly pursue the legal investigation of this crime through all international and human rights legal capacities and asks the international community to take responsible, clear and impartial action in the face of this human calamity.
