بیانیه ستاد حقوق بشر در اعتراض به حمله وحشیانه به مدرسه دخترانه در شهر میناب

به گزارش خبرگزاری آگاه، ستاد حقوق بشر طی بیانیه‌ای، حمله تروریستی رژیم صهیونیستی و آمریکا را به مدرسه دخترانه در شهر میناب که منجر به شهادت و مجروحیت شمار زیادی از کودکان بی‌گناه و بی‌دفاع کشورمان شد، محکوم کرد.

متن این بیانیه به شرح زیر است: 

ستاد حقوق بشر جمهوری اسلامی ایران با شدیدترین عبارات، حمله تروریستی به مدرسه دخترانه در شهر میناب را که در جریان تجاوز وحشیانه رژیم صهیونیستی و ایالات متحده آمریکا رخ داده و به شهادت ۱۶۵ کودک بی‌گناه و مجروحیت ده‌ها نفر انجامیده است، به‌عنوان جنایتی هولناک، سازمان‌یافته و غیرقابل توجیه محکوم می‌کند.

بر اساس گزارش‌های اولیه، این حمله در ساعاتی صورت گرفته که دانش‌آموزان در کلاس‌های درس حضور داشته‌اند؛ امری که ماهیت غیرنظامی و آموزشی هدف را آشکارتر ساخته و هرگونه ادعای توجیه نظامی را مردود می‌سازد. هدف قرار دادن کودکان در محیطی که باید امن‌ترین مکان برای رشد، آموزش و تربیت آگاهن باشد، نشان‌دهنده بی‌اعتنایی مطلق عاملان این اقدام به کرامت انسانی و قواعد آمره حقوق بین‌الملل است.

این جنایت، نقض صریح اصول بنیادین حقوق بین‌الملل بشردوستانه از جمله اصل تفکیک میان اهداف نظامی و غیرنظامی، اصل تناسب، اصل احتیاط در حملات و ممنوعیت حمله به اماکن غیرنظامی است که در کنوانسیون‌های چهارگانه ژنو ۱۹۴۹ و پروتکل‌های الحاقی آن تصریح شده‌اند. مدارس و مراکز آموزشی به‌عنوان اموال و اماکن غیرنظامی از حمایت ویژه برخوردارند و هرگونه حمله عامدانه به آنها می‌تواند مصداق جنایت جنگی تلقی شود.

افزون بر این، این اقدام آشکارا با تعهدات مندرج در کنوانسیون حقوق کودک در تعارض است. مطابق این کنوانسیون، کودکان از حق ذاتی حیات، بقا، رشد، آموزش و از امنیّت کامل برخوردارند و دولت‌ها مکلّف‌اند در تمامی شرایط، حمایت ویژه و مؤثر از آگاهن به‌عمل آورند. حمله به یک مدرسه دخترانه، نقض مستقیم حقوق بنیادین کودک وتعرّضی بی‌سابقه به اصل حمایت مضاعف از کودکان در مخاصمات مسلحانه است.

ستاد حقوق بشر جمهوری اسلامی ایران ضمن ابراز همدردی عمیق با خانواده‌های داغدار، معلمان و مردم شریف میناب، تأکید می‌کند که این حادثه نه یک رویداد مقطعی، بلکه نماد خطرناک عادی‌سازی خشونت علیه غیرنظامیان به ویژه کودکان است. بی‌کیفر ماندن چنین جنایاتی، چرخه مصونیت از مجازات را تقویت کرده و امنیّت جمعی را به مخاطره می‌اندازد.

در این میان، سکوت و انفعال برخی سازوکار‌های بین‌المللی حقوق بشری و نهاد‌های مدعی دفاع از حقوق کودک، موجب نگرانی جدی است. استاندارد‌های دوگانه، سیاسی‌کاری و واکنش‌های گزینشی، اعتبار نظام بین‌المللی حمایت از حقوق بشر به ویژه حقوق کودکان را خدشه‌دار کرده و اعتماد ملت‌ها را نسبت به کارآمدی این نهاد‌ها تضعیف می‌کند.

ستاد حقوق بشر جمهوری اسلامی ایران اعلام می‌دارد که پیگیری حقوقی این حادثه از طریق مجاری ملّی و بین‌المللی، از جمله بهره‌گیری از ظرفیت‌های موجود در نظام عدالت کیفری بین‌المللی، را با قاطعیت دنبال خواهد کرد و مسؤولیت کیفری عاملان، آمران و حامیان این جنایت را تا تحقق کامل عدالت مورد مطالبه قرار خواهد داد.

بی‌تردید، هدف قرار دادن کودکان بی‌دفاع، عبور از تمامی خطوط قرمز حقوقی، انسانی و اخلاقی است و جامعه جهانی در برابر این آزمون تاریخی مسؤول است. استمرار سکوت در برابر چنین فجایعی، نه‌تنها هم‌دستی غیرمستقیم با ناقضان حقوق بشر تلقی می‌شود، بلکه زمینه‌ساز تکرار جنایات علیه نسل‌های آینده خواهد بود.

Statement by the High Council for Human Rights of the Islamic Republic of Iran Condemning the Brutal Attack on a Girls’ School in Minab

The High Council for Human Rights of the Islamic Republic of Iran condemns in the strongest terms the terrorist attack on a girls' school in the city of Minab, which took place amidst the brutal aggression of the Zionist regime and the United States of America, resulting in the martyrdom of over ۱۶۵ innocent children, describing it as a “heinous, organized, and unjustifiable atrocity. ”

According to preliminary reports, the strike was executed while students were in attendance; a circumstance that unequivocally establishes the civilian and educational nature of the target and precludes any legitimate claim of military necessity. Targeting children within an environment that should be the safest for their development and education demonstrates the perpetrators' absolute disrespect for human dignity and the peremptory norms (jus cogens) of international law.

This act constitutes a flagrant violation of the fundamental principles of International Humanitarian Law (IHL) , notably the principles of distinction, proportionality, and precaution in attack, as well as the prohibition of targeting civilian objects, as enshrined in the Four Geneva Conventions of ۱۹۴۹ and their Additional Protocols. Schools and educational centers, enjoying special protection under international law as civilian objects, are subject to the principle of immunity; consequently, any intentional attack against them may qualify as a war crime.

Furthermore, this action stands in blatant contradiction to the obligations stipulated in the Convention on the Rights of the Child (CRC). Pursuant to this Convention, children possess inherent rights to life, survival, development, and education, and State Parties are obligated to ensure their special protection. The deliberate targeting of a girls' school constitutes a direct violation of the child's fundamental rights and an unprecedented assault on the principle of the double protection afforded to children in situations of armed conflict.

While expressing profound solidarity with the bereaved families, teachers, and the resilient people of Minab, the High Council for Human Rights of the Islamic Republic of Iran emphasizes that this incident is not an isolated occurrence but a dangerous manifestation of the normalization of violence against civilians, particularly children. The impunity surrounding such crimes reinforces the cycle of exemption from punishment and poses a grave threat to collective security.

Meanwhile, the silence and inaction of certain international human rights mechanisms and institutions claiming to advocate for children's rights are a matter of grave concern. Double standards, politicization, and selective response have eroded the credibility of the international human rights protection regime, specifically regarding children's rights, and undermined nations' confidence in the efficacy of these institutions.

The High Council for Human Rights of the Islamic Republic of Iran declares that it will pursue the legal redress for this incident through national and international jurisdictions, including leveraging the capacities of the international criminal justice system, and will demand the individual criminal responsibility of the perpetrators, inciters, and sponsors of this crime until full justice is realized.

Undoubtedly, targeting defenseless children constitutes a transgression of all legal, humanitarian, and ethical red lines, placing the international community under a historic obligation. Continued silence in the face of such atrocities not only amounts to indirect complicity with human rights violators but also paves the way for the recurrence of crimes against future generations.
